Terms and Conditions:

1. These terms and conditions together with any .terms and conditions in a contract of sale signed between Country Rose Limited and a buyer for the purchase of a Qualifying Property as defined below (the “Contract of Sale “and the “Buyer(s)” respectively) are the terms and conditions applicable to Country Rose Limited’s offer of a car gift (the “Offer” and the “Terms and Conditions” respectively).
2. The Offer will apply to the first purchase of a newly constructed Country Rose Limited (“CR”) property in the Compose, Classic and Sterling developments (the “Qualifying Properties”) made directly from CR between 01/03/2010 and 01/06/2010 or as otherwise expressly stated herein.  By purchasing a Qualifying Property from CR you agree to be bound by these Terms and Conditions;
3. CR will give one new Mercedes car (the “Car”)of a model described below and  specifications (to be provided on request) to the Buyer(s) of a Qualifying Property simultaneously with the delivery of the Qualifying Property and the full settlement of the purchase price and /or other sums payable under a signed Contract of Sale, provided that such contract is signed between 01/03/2010 and 01/06/2010 as follows:
   • For each CR Qualifying Property purchased for a purchase consideration of  between €240,000 + Vat up to  €421,000 + Vat CR one Mercedes B160 Sports Tourer (subject to availability);
   • For each CR Qualifying Property purchase for a purchase consideration from €422,000 + Vat and above CR one Mercedes E200 CGI Coupe (subject to availability).
4. CR reserves the right to withdraw, cancel or amend the Offer without notice in the event of a catastrophe, war, civil or military disturbance, Act of God or any actual or anticipated breach of any applicable law or regulation or any other event outside CRs control. 
5. In the event of any dispute regarding the Offer and all other matters relating thereto, the decision of CR shall be final and no correspondence or discussion shall be entered into.
6. In the event of any difference, discrepancy and/or contradiction between these present Terms and Conditions and the terms and conditions in the Contract of Sale for the purchase of a Qualifying Property entered into between CR and a Buyer(s) the terms and conditions in the Contract of Sale shall prevail.
7. The intention to accept the Offer must be made known by the Buyer(s) to CR prior to the time of signing of the Contract of Sale and in any event before execution of the same.  Failure to disclose the intention to accept the offer within the time provided herein may, at the absolute discretion of CR, result in disqualification from the Offer.
8. All taxes, registration costs, insurances and other similar expenses relating to the Car and the use of the Car as the case may be and whether payable once or yearly will be the responsibility of the Buyer(s).  For the avoidance of doubt CR is only responsible for the initial purchase price of the Car.
9. CR shall not in any way be responsible and cannot accept any responsibility for any damage, injury or other loss suffered by a Buyer(s) or third party as a result of taking up the Offer or accepting the Car whether due to any error, omission or other cause by CR.  CR is not responsible for any services, problems or technical malfunction of the Car or for any losses or damages of whatever nature that may be caused to a Buyer(s) or to any third person as a result of the ownership and/or use of the Car.
10. The Car will be purchased in the name of .a Buyer or where the Buyer is more than one person, in the name of one of the Buyers, and thereafter be the sole responsibility of that Buyer.
11. Only one Car will be given per each purchase of a CR Qualifying Property.
12. CR reserves the right to amend the Offer, the duration of the Offer and the present Terms and Conditions at any time at its absolute discretion.
13. The Car will be purchased in the name of one of the Buyer(s) appearing in the Contract of Sale.  The Car will not be purchased in the name of any other party.
14. The Car may be exchanged with a cash gift or cash deduction against the purchase price at the sole discretion of CR, at any time whether before or after signing the Contract of Sale.  In this case the value of the cash gift alternative or cash deduction will be solely decided by CR, whose decision shall be final. Where such an exchange is initiated by a Buyer, it must be agreed between CR and the Buyer prior to the signing of the Contract of Sale, otherwise CR shall have the right to reject such an exchange and/or request for exchange at its absolute discretion
15. If the listed Mercedes cars at part 3 above are not available then CR reserves the right to offer an alternative car of similar value of the same or other brand.
16. Cars will be delivered simultaneously with delivery of the Qualifying Property.  For the avoidance of doubt, no Car will be given for any purchase which is not completely paid for at the time of delivery of the Qualifying Property and delivered in accordance with the Contract of Sale.
17. The Offer and these Terms and Conditions shall be exclusively governed by and construed in accordance with the laws of Cyprus.
